Gnarly90 Waiver & Terms

1. Assumption

By registering for or participating in the Gnarly90 Challenge, you acknowledge and accept that physical activity and fundraising events carry inherent risks, including but not limited to injury, illness, fatigue, and, in rare cases, death. You understand it is your responsibility to ensure you are physically and mentally fit to take part, and that you have sought medical advice if needed before starting your challenge.

2. Waiver

You voluntarily waive any and all rights to claim against Gnarly Neighbours Inc., its directors, employees, volunteers, sponsors, and partners for any loss, injury, damage, or harm arising from your participation in the Gnarly90, except where such loss is caused by our proven negligence.

3. Release

You release and discharge Gnarly Neighbours Inc. from all liability, claims, and demands related to any injury, illness, damage, or loss you may suffer in connection with the Gnarly90. This release applies whether the event is undertaken in person, online, or in any location of your choosing.

4. Responsibility

You are solely responsible for:

• Choosing a challenge that is safe and appropriate for your personal health and abilities.

• Using suitable equipment and following safety guidelines.

• Ensuring any fundraising activities comply with relevant laws and regulations.

• Supervising any minors who participate under your guidance.

5. Clause

If any part of this waiver is found to be unenforceable, the remaining provisions will still apply in full.

6. Safety

You agree to take reasonable precautions during your challenge, including:

• Warming up and stretching before physical activity.

• Staying hydrated and resting when needed.

• Avoiding unsafe locations or hazardous conditions.

• Following road rules and public safety laws.

If you feel unwell at any time, you agree to stop your activity and seek appropriate medical attention.

7. Terms of Use

By using the Gnarly90 website, registering for the challenge, or engaging with our campaign materials, you agree not to misuse our platforms, share offensive content, or infringe on any intellectual property rights. You also agree that any photos, videos, or stories you share with us may be used for promotional purposes, with appropriate credit where possible.

8. Governing Law

This waiver is governed by the laws of Victoria, Australia, and you agree to submit to the jurisdiction of its courts in the event of any dispute.

9. Agreement

By registering for the Gnarly90 Challenge, you confirm that you have read, understood, and agreed to this waiver and terms. If registering on behalf of a minor, you confirm you are their parent or legal guardian and give consent for their participation under these terms.
